1. Purpose

These general terms of use (GTU) govern the access and use of the mobile application Cavrya, published under the trade name Glabs325 by Ramah GUEDEGBE, sole proprietor, SIREN 523 501 765, whose contact address is located at 235 rue Saint-Honore, 75001 Paris, France.

2. Acceptance

By installing, opening or using Cavrya, you accept these Terms of Use.

3. Service Description

Cavrya is an application to assist in calculating the LSI (Langelier Saturation Index) and interpreting water balance for swimming pools and similar basins.

The application notably allows to enter water measurements, calculate a balance index, display analysis factors, suggest corrective actions, and retain a local history according to the features available in the version used.

4. Informative Nature of the Application

Cavrya is a decision-support tool. The application does not replace laboratory analysis, nor the manufacturer's instructions for treatment products, nor the regulatory obligations applicable to your installation.

You remain solely responsible for verifying the entered measurements, the choice of products, the dosages actually applied, and compliance with chemical safety rules.

5. Access and Use

The primary use of Cavrya is designed to operate without a named user account and, for its core functions, without a permanent connection.

You agree to use the application in accordance with its purpose, lawfully, and without seeking to compromise its integrity, its code, or its operation.

6. User License

Glabs325 grants you a personal, non-exclusive, non-transferable, and revocable license allowing you to use Cavrya for your own use, subject to your compliance with these Terms of Use and the terms of the relevant distribution store.

7. Data and Backups

Pool data, measurements, preferences, and history may be stored locally on your device. Unless expressly stated in a particular feature, Glabs325 does not provide named cloud hosting for this content.

You remain responsible for protecting your device, your system backups, and for retaining your data.

8. Notifications and Local Functions

Certain functions may use local notifications, preferences stored on the device, or a local database to improve the user experience. These mechanisms do not constitute a guarantee of outcome nor a guarantee of timely alert in all situations.

9. Paid Features and Subscriptions

Certain features may be offered for a fee, including in the form of an in-app purchase, a monthly subscription, an annual subscription, or a lifetime purchase ("lifetime"), depending on your device, your store, and the version of Cavrya used.

The price, currency, billing period, included features, renewal conditions, and useful information before purchase confirmation are displayed on the relevant purchase screen and/or by the Apple App Store or the Google Play Store.

Purchases, renewals, cancellations, restorations, and any refunds are managed by the applicable distribution platform and remain subject to its own terms and conditions. The management or termination of a subscription is carried out from the settings of the associated Apple or Google account, as applicable. The lifetime purchase, when offered, corresponds to a non-recurring unlock for the store account that made the purchase, subject to the conditions of the applicable platform.

The legal guarantees applicable to digital content and services, as well as your mandatory consumer rights, remain applicable.

10. Evolution and Updates

Glabs325 may correct, suspend, modify, or evolve all or part of Cavrya at any time, in particular for reasons of maintenance, stability, security, product clarity, or compliance.

Some older versions may no longer be supported.

11. Limitation of Liability

Cavrya is provided "as is". To the extent permitted by law, Glabs325 shall not be held liable for indirect damages, loss of data, loss of business, errors in entered measurements, dosing errors made by the user, nor for consequences related to chemicals used.

The displayed recommendations must always be compared with product labels, industry best practices and, if necessary, with a second water test.

No provision of these General Terms of Use limits the statutory rights you benefit from as a consumer, nor liability which cannot be excluded or limited under applicable law.

12. Intellectual Property

The application, its engine, its content, its design, its trademarks, its texts, its code, and its graphical elements are protected by applicable intellectual property rights. Any unauthorized reproduction or extraction is prohibited.

13. Termination

You may cease using the application at any time by uninstalling it. Glabs325 may suspend or limit usage in case of unlawful, fraudulent use or use contrary to these General Terms of Use.

When a paid subscription is active, its termination or non-renewal takes effect according to the rules of the store through which it was subscribed.

14. Applicable Law

These General Terms of Use are governed by French law, subject to the mandatory consumer protection provisions applicable in your country of residence.

15. Consumer Mediation

In accordance with Articles L.612-1 et seq. of the French Consumer Code, any consumer has the right to free recourse to a consumer mediator for the amicable resolution of a dispute with Glabs325, after a prior written complaint has remained unresolved.

The appointed mediator is CM2C - Centre de la Mediation de la Consommation de Conciliateurs de Justice (Center for Consumer Mediation of Justice Conciliators), 49 Rue de Ponthieu, 75008 Paris, website: www.cm2c.net.
